The specific scope of services will be outlined in customized agreements with each client.
3. Client Responsibilities
The client agrees to:
- Provide all necessary logos, information, approvals, and credentials needed for R.K. Enterprise to execute the agreed digital marketing campaigns in a timely manner.
- Respond to communications within a reasonable timeframe.
- Ensure all content and materials provided are accurate, lawful, and do not infringe on any third-party rights.
Delays caused by the client may result in project delivery delays.
4. Payment Terms
Payment terms will be specified in individual client agreements. Unless otherwise agreed, payment is due upon receipt of invoice. Late payments may incur additional charges as specified in the agreement.
5. Intellectual Property
The site and its original content, features, and functionality are owned by R.K. Enterprise and are protected by intellectual property laws. Any deliverables created for the client become the client's property upon full payment, unless otherwise specified in the agreement.
6. Disclaimer of Warranties
While we use our best professional efforts to achieve successful outcomes for our clients, R.K. Enterprise does not guarantee specific results. Digital marketing relies on third-party platforms (like Google, Facebook) whose algorithms frequently change. R.K. Enterprise is an independent agency and past performance does not guarantee future results.
7. Limitation of Liability
In no event shall R.K. Enterprise be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of our services, whether based on warranty, contract, tort, or any other legal theory.
8. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the business relationship. This obligation survives termination of any agreement between the parties.
9. Termination
Either party may terminate the service agreement with written notice as specified in the individual client agreement. Upon termination, the client shall pay for all services rendered up to the date of termination.
10. Governing Law
This agreement shall be governed in accordance with the laws of Gujarat, India, and specifically under the jurisdiction of courts in Bhavnagar.
11. Changes to Terms
R.K. Enterprise reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on this website. Your continued use of the website after changes constitutes acceptance of the modified terms.
